Smyth & Jones is a wholly owned division of Archipel, Inc., a U.S.-based company registered in the State of Florida. Our products are designed in the U.S. and Europe and shipped worldwide from our distribution hub in Portugal.

We are committed to delivering high-quality, design-forward merchandising solutions to our global clients. Please read the following Terms and Conditions carefully before placing your order. By purchasing from Smyth & Jones, you agree to the terms outlined below.

1. Customer Satisfaction

We want our clients to be fully satisfied with their experience. While we take great care to ensure the highest level of craftsmanship and shipping integrity, we do not accept returns except in the case of products damaged in transit.

2. Returns & Claims Policy

We only accept returns or issue merchandise credit/refunds under the following conditions:

A. Damage Notification Window

You must notify us of any damage within 3 (three) calendar days of delivery. Notifications received after this period may be denied.

B. Required Documentation

To be eligible for a return, credit, or refund, your claim must include:

  • Clear, dated photographs showing the damage to the product
  • Images of the shipping carton and any visible external damage
  • A written description of the issue
  • Retention of all original shipping materials (carton, documents, inner packaging)

C. Eligibility and Resolution

Once approved, Smyth & Jones may offer either:

  • A merchandise credit, or
  • A refund to your original form of payment

We may request return shipment of the damaged item before issuing credit or refund. Return shipping instructions will be provided if needed.

3. Non-Returnable Items

We do not accept returns for:

  • Buyer’s remorse
  • Change of design direction
  • Custom or made-to-order products
  • Items reported as damaged outside the 3-day window

4. Terms of Sale

A. Pricing & Currency

All prices are listed in USD or EUR, depending on your region. Prices are exclusive of VAT, customs duties, or other applicable import taxes unless otherwise specified.

B. Payment Terms

Payment is required in full prior to shipment unless otherwise agreed in writing.

Accepted forms of payment include major credit cards, bank transfers, and business invoicing for approved accounts.

Custom Orders: 50% deposit to confirm order. Samples produced for client approval once purchase order and deposit are received. 50% balance payment due prior to shipping of goods.

C. Order Confirmation

All orders are subject to availability and formal acceptance by Smyth & Jones. You will receive written confirmation once your order is processed.

5. International Shipping & Taxes

A. Duties & VAT

Orders shipped outside the U.S. or EU may be subject to import taxes, customs duties, and fees levied by the destination country. These charges are the responsibility of the customer.

B. Shipping Delays

Delivery times may vary based on destination and customs procedures. Smyth & Jones is not responsible for delays caused by customs clearance, weather, carrier disruptions, or force majeure events.

6. Intellectual Property

All content, designs, product names, and images on our website and materials are the property of Smyth & Jones / Archipel, Inc. and may not be copied, reproduced, or used without express written permission.

7. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the State of Florida and applicable U.S. federal law. For sales to EU-based customers, we comply with EU consumer protection laws, including Directive 2011/83/EU on consumer rights.

Disputes shall be resolved in the courts of the seller's jurisdiction, unless otherwise required by overriding consumer protection regulations.

8. Modifications

We reserve the right to update or change these Terms & Conditions at any time. Please review this page periodically. Continued use of our services after any changes constitutes your agreement to those changes.
